We regularly advise airports, airlines, lenders, suppliers, and service providers on procurement, construction, operation, and maintenance of major airport projects. Our team is well regarded for handling cross-border and high-value commercial litigation and arbitration, acting for key actors in the aviation industry. .
Our aviation practice spans various aspects of the industry including regulation and compliance both at national and international levels, air traffic rights, transactional advice and support including drafting and review of contracts, litigation, among others. Members of our team have been involved in high profile litigation in the aviation sector in the country. We have also previously conducted an extensive legal audit of the Kenya Civil Aviation Authority. We are in the panel of advocates for Kenya Civil Aviation Authority and Kenya Airports Authority. We work closely with a law firm based in London, UK which specializes in aviation practice.
Our partners have attended a number of aviation symposiums organized by Civil Aviation Safety and Security Oversight Agency (CASSOA), Civil Aviation Safety and Security Oversight Agency (CANSO) and The International Civil Aviation Organization (ICAO). We recently also attended an Air Law conference ran by Strathmore University – which focused on developments on aviation liability relating to the Ethiopian Airline and Lion Air crashes. We have also undertaken the International Air Law Course offered by ICAO.
We have recently advised on:
- Handling litigation arising from an air accident which occurred at the Manda Airport on 31.10.2015. We are defending Kenya Airports Authority in conjunction with a London law firm.
- Conducting a regulatory and compliance work for Kenya Civil Aviation Authority where we advised on a number of aviation security and safety matters including review of a matter relating to an air crash in Busia Kenya in 2003.
- One of our partners has been previously involved in the following aviation matters: Investigations carried out by French authorities in respect of Kenya Airways crash in Cote d’Ivoire which occurred on 30.1.2000; Compensation claims for the victims in the Kenya Airways accident in Douala, Cameroon. She was involved in facilitating discussions and negotiations with family members of the victims, drafting succession proceedings, drafting and reviewing release and settlement agreements and applications to court for approval of settlement in cases involving minors; Litigation arising out of the Kenya Airways accident that occurred on 11.4.2014 at Julius Nyerere International Airport in Tanzania; Litigation arising out of the Mombasa Air crash accident which occurred on 22.8.2012 near Ngerede Airstrip in Masai Mara, Kenya.
